Gensomnia is an AI-powered platform that enables users to generate digital images with customizable parameters and character selections. Our technology processes user inputs to create unique visual content. We do not permanently store or monitor user-generated content or uploaded images.

3. Eligibility Requirements

To use Gensomnia, you must:

• Be at least 18 years old or the age of majority in your jurisdiction
• Have the legal capacity to enter into binding agreements
• Not be prohibited from using the service under applicable laws

By using our service, you represent and warrant that you meet these requirements.

4. User Responsibilities

You are solely responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Ensuring your use complies with all applicable laws and regulations
• Obtaining necessary consents for any images involving identifiable individuals

Generating images of individuals without their explicit consent or images depicting minors is strictly prohibited and will result in immediate account termination.

5. Payment Terms

All purchases on Gensomnia are one-time transactions. We do not implement automatic subscriptions, recurring billing, or auto-renewal charges. Key payment details:

• One credit equals one image generation across all plans
• Credits are non-transferable between accounts
• Pricing is displayed in your local currency where available
• All prices are final at the time of purchase

6. Refund Policy

Refund requests must be submitted within 24 hours of payment. Refunds will not be granted if you have consumed more than 20 credits, regardless of the time elapsed since purchase. To request a refund, contact our support team with your transaction details.

7. Intellectual Property

Intellectual property rights are distributed as follows:

• You retain ownership rights to images you generate using our service
• Gensomnia retains all rights to the underlying AI models, algorithms, and platform technology
• You may not use generated content to train competing AI systems
• Our trademarks, logos, and brand elements remain our exclusive property

8. Prohibited Uses

You agree not to use Gensomnia to:

• Generate content involving minors in any context
• Create non-consensual imagery of real individuals
• Produce content that violates any applicable laws
• Circumvent any technical limitations or security measures
• Resell, redistribute, or commercially exploit the service without authorization

9. Service Availability

We strive to maintain consistent service availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any aspect of the service at any time without prior notice. Scheduled maintenance will be communicated in advance when possible.

10. Disclaimer of Warranties

Gensomnia is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the service will meet your specific requirements, operate without interruption, or be error-free.

11. Limitation of Liability

To the maximum extent permitted by law, Gensomnia and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the service.

12. Dispute Resolution

If you have concerns about the service, please contact our support team first. We aim to resolve disputes informally. Filing a chargeback without first attempting resolution through our support channels will result in immediate account suspension and forfeiture of remaining credits.

13. Termination

We reserve the right to suspend or terminate your account at our discretion, particularly for violations of these terms or our Acceptable Use Policy. Upon termination, your right to use the service ceases immediately, and unused credits may be forfeited.

14. Changes to Terms

We may update these Terms of Service periodically. Material changes will be communicated through our platform or via email. Your continued use of Gensomnia after changes take effect constitutes acceptance of the revised terms.
