1. Acceptance of Terms

By accessing or using Gensomnia, you confirm that you have read, understood, and agree to these Terms of Service. If you do not agree to these terms, you must stop using the service.

2. Service Description

Gensomnia is an 18+ AI image generation platform for fictional, illustrated, and stylized character artwork. The service lets users choose visual parameters, upload permitted reference materials, and generate digital images through third-party AI infrastructure.

3. Eligibility

To use Gensomnia, you must:

• Be at least 18 years old or the age of majority in your jurisdiction.
• Be legally allowed to access adult-oriented digital services.
• Have the legal capacity to enter into binding agreements.
• Not be prohibited from using the service under applicable law.

We may suspend or terminate accounts if we believe the user is underage or is using the service in a prohibited jurisdiction.

4. User Responsibilities

You are responsible for:

• Keeping your account credentials secure.
• All activity that occurs under your account.
• Ensuring that your prompts, uploads, and outputs comply with law.
• Using only materials that you have the right to use.
• Reviewing generated outputs before saving, sharing, or using them.

5. Prohibited Content

The following content is strictly prohibited on Gensomnia:

• Any content involving minors or underage-looking persons.
• Any content depicting, resembling, or claiming to depict real persons.
• Non-consensual, abusive, exploitative, or harassing content.
• Illegal content or content that promotes illegal activity.
• Content that infringes copyright, trademark, privacy, publicity, or other rights.
• Attempts to bypass safety systems, rate limits, age checks, or payment controls.

6. Payments, Credits, and Plans

Gensomnia may offer prepaid credit packs and time-limited memberships. Available products, included credits, and prices are shown on the Pricing page and at checkout.

• Credits are a digital balance used for image generation.
• Current generation cost is shown in the app before you generate.
• Credits and memberships are tied to your account and are not transferable.
• Checkout shows the available payment providers before redirecting you to payment.
• Recurring billing will only apply if it is clearly disclosed at checkout.
• Prices, promotions, and included benefits may change for future purchases.

7. Refunds

Refunds are handled under our Refund Policy. Because the service provides digital goods and computing resources, refunds may be refused after credits, generations, or membership benefits have been materially used, or where an account violated our Terms or policies.

8. Intellectual Property

You are responsible for the rights in your prompts, uploads, and use of outputs. Gensomnia does not grant permission to use third-party intellectual property or real-person likeness rights.

• You retain the rights you already hold in materials you provide.
• Gensomnia retains all rights in the platform, software, brand, and technology.
• You may not use the service or outputs to train competing AI systems.
• We may remove content or restrict accounts in response to rights complaints.

9. Complaints and Abuse Reports

If you believe content or activity on Gensomnia violates these Terms, our policies, or your rights, contact us under our Complaint and Abuse Policy. We may investigate, remove content, restrict accounts, preserve evidence, or report illegal activity to appropriate authorities.

10. Service Availability

We work to keep the service available, but we do not guarantee uninterrupted access. AI processing, payment providers, hosting, or third-party infrastructure may fail or become unavailable. We may modify, suspend, or discontinue parts of the service at any time.

11. Disclaimer of Warranties

Gensomnia is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not guarantee that outputs will meet your expectations, be unique, be legally usable for a particular purpose, or be error-free.

12. Limitation of Liability

To the maximum extent permitted by law, Gensomnia and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunity, arising from your use of the service.

13. Termination

We may suspend or terminate access for policy violations, fraud, chargeback abuse, safety risks, illegal activity, or any use that harms users, third parties, payment partners, or Gensomnia. Upon termination, your right to use the service stops immediately.

14. Changes to Terms

We may update these Terms periodically. Material changes may be communicated through the platform or by email. Continued use after changes take effect means you accept the revised Terms.
